This End User License Agreement (“EULA” or “Agreement”) is a binding agreement between you (“you” or “End-User”) and StreamPicks (“StreamPicks”, “we”, “us”, or “our”) governing your license to use the StreamPicks mobile application and any related services (the “Licensed Application”).
By downloading, installing, or using the Licensed Application, you agree to this EULA. This EULA incorporates by reference, and you also agree to, the StreamPicks Terms of Service and Privacy Policy, which describe the Service, your account, creator names and likenesses, content and moderation, virtual items, and other terms in more detail. To the extent this EULA and the Terms of Service conflict on a matter specific to your license to use the app obtained from an app marketplace, this EULA controls; the Terms of Service otherwise govern your use of the Service. If you do not agree, do not use the Licensed Application.
1. Acknowledgement
This EULA is concluded between you and StreamPicks only, and not with Apple Inc. (“Apple”), Google LLC (“Google”), or any other app marketplace operator. StreamPicks, not the marketplace, is solely responsible for the Licensed Application and its content. This EULA does not provide usage rules for the Licensed Application that conflict with the Apple Media Services Terms and Conditions or the Google Play Terms of Service, and StreamPicks acknowledges that it had the opportunity to review those terms. Where the Licensed Application was obtained from the Apple App Store, “Usage Rules” means the usage rules set out in the Apple Media Services Terms and Conditions.
2. Scope of License
StreamPicks grants you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use the Licensed Application on any Apple-branded or other compatible device that you own or control, as permitted by the Usage Rules and any applicable marketplace terms, and solely for your personal, non-commercial entertainment. Where obtained from the Apple App Store, the Licensed Application may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where enabled. You may not rent, lease, lend, sell, redistribute, sublicense, copy (except as expressly permitted), modify, reverse engineer, decompile, disassemble, or create derivative works of the Licensed Application or any part of it, except to the extent applicable law prohibits such a restriction.
3. Eligibility & age
The Licensed Application is for users aged 13 and over. You must be at least 13 years old to create an account or use the Licensed Application, and when you create an account you confirm that you are at least 13 years old. If you are under 13, you may not create an account or use the Licensed Application. If you are at least 13 but under the age of majority where you live, you may use the Licensed Application only with the involvement and consent of a parent or legal guardian. Live chat, community posting, and other social and interactive features are available to all registered users, all of whom are 13 or older. We do not knowingly allow children under 13 to create an account or provide personal information.
4. Virtual items, currency, purchases & subscriptions
The Licensed Application is free to download. It offers optional in-app purchases, including the StreamPicks Plus auto-renewing subscription (offered on a monthly or yearly basis) and consumable purchases of Creator Coins and items. The subscription title, length, and price (and, where applicable, the price per unit) are shown in the app at the time of purchase. A subscription automatically renews at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period; you can manage or cancel a subscription in your App Store or Google Play account settings, and access continues until the end of the paid period. Payment is charged to your marketplace account. Creator Coins and virtual items are licensed, not sold, to you for use within the Service; they have no real-world or cash value and cannot be redeemed, transferred, or sold outside the Service. Refunds, when available, are handled by the App Store or Google Play under their policies.
5. Consent to use of data
You agree that StreamPicks may collect and use technical data and related information — including device, system, and application information — to provide and improve the Licensed Application and its services, as described in our Privacy Policy. We handle personal information as described in that policy.
6. Maintenance and support
StreamPicks is solely responsible for providing any maintenance and support services for the Licensed Application, as required under applicable law or as we choose to offer. You and StreamPicks acknowledge that Apple (and any other marketplace operator) has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
7. Warranty
StreamPicks is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. To the maximum extent permitted by applicable law, the Licensed Application is provided “as is” and “as available” without warranty of any kind. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Licensed Application to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be StreamPicks’ sole responsibility.
8. Product claims
StreamPicks, not Apple or any other marketplace operator, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit StreamPicks’ liability to you beyond what is permitted by applicable law.
9. Intellectual property rights
In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, StreamPicks, not Apple or any other marketplace operator, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim. The Licensed Application — including its software, design, branding, and original card artwork — is owned by StreamPicks or its licensors. Creator names, marks, and likenesses, and third-party platform names and logos, remain the property of their respective owners and are used as described in the Terms of Service.
10. Legal compliance
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist-supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable U.S. and other export and re-export control laws and regulations in your use of the Licensed Application.
11. Third-party terms
You must comply with applicable third-party terms of agreement when using the Licensed Application — including, where applicable, the Apple Media Services Terms and Conditions, the Google Play Terms of Service, and your wireless data-service agreement.
12. Acceptable use
You agree not to use the Licensed Application to: harass, threaten, impersonate, or harm others; post content that is illegal, hateful, sexual, violent, or otherwise prohibited; cheat, exploit bugs, use bots, or manipulate matchmaking, the economy, or rankings; buy, sell, or transfer accounts, items, or currency outside the Service; or reverse engineer, scrape, or interfere with the Service or its security. Additional rules are set out in the Terms of Service. We may remove content and suspend or terminate accounts that violate these rules.
13. Limitation of liability
To the maximum extent permitted by law, StreamPicks and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, lost virtual items or currency, or service interruptions, arising from your use of the Licensed Application. Nothing in this EULA limits liability that cannot be limited by applicable law.
14. Termination
This license is effective until terminated. Your rights under this EULA terminate automatically, without notice, if you fail to comply with any of its terms. You may stop using the Licensed Application and delete your account at any time (see our data deletion page). Upon termination, you must stop all use of the Licensed Application; virtual items and currency are forfeited, to the extent permitted by law.
15. Governing law
This EULA is governed by the laws applicable where the operator of StreamPicks is established, without regard to its conflict-of-laws rules, except where applicable consumer-protection law gives you a different right. App Store and Google Play purchases are also subject to those marketplaces’ terms.
16. Third-party beneficiary
You and StreamPicks acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.
